Any adult resident of Ontario can apply to adopt (Single, Married, or Common Law).
All adoptions (except some relative cases) require a SAFE Home Study and PRIDE Training.
Public (CAS) adoption takes longer but is free. Private adoption is faster but costs $15k-$30k+.
Adoption is a beautiful emotional journey, but a rigorous legal obstacle course. You have the love and the home—we have the legal roadmap.
The Problem: One missing document, one incomplete background check, one improperly drafted consent form can delay your adoption by months. The process involves multiple government agencies, licensed social workers, and strict court procedures.
The Solution: Tailor Law manages the Licensees, the Children's Aid Society, and the Courts for you. We cut the red tape so you can focus on preparing your home and your heart.
Each adoption path has unique requirements, timelines, and costs. We guide you through the right process for your family.
Adopting through Children's Aid Society. These are typically older children or sibling groups who need permanent homes.
Adopting newborns or infants through licensed adoption agencies. Birth parents choose adoptive families.
Competitive process. Requires profile creation and birth parent matching.
Bringing a child to Canada from another country. Requires compliance with both Ontario law and the child's country of origin.
Requires coordination with Immigration, Refugees and Citizenship Canada (IRCC).
Formalizing existing family bonds. Step-parents adopting their partner's child, or grandparents/aunts/uncles adopting relatives.
Home study may be waived if child has lived with you for 2+ years.
The most common obstacle in private and step-parent adoptions
In private and step-parent adoptions, biological parents must either consent to the adoption or have their parental rights terminated by the court. This is often the most emotionally charged and legally complex part of the process.
"We handle the uncomfortable conversations with biological parents so you don't have to. Our approach is firm but respectful—protecting your adoption while minimizing conflict."
— Deepa Tailor, Senior Family Lawyer
If the biological father's identity is unknown or he cannot be located, we must conduct a diligent search and publish legal notices. This adds 3-6 months to the timeline but is legally required.

After months of preparation, the court hearing is the moment your family becomes legally permanent.
We submit your Application for Adoption to the Ontario Court of Justice, along with all supporting documents (home study, consents, background checks).
The hearing is typically brief (15-30 minutes) and celebratory. The judge will ask you about your readiness and commitment to the child.
The judge signs the Order of Adoption. This creates a permanent, irrevocable legal parent-child relationship.
After adoption, your child has full inheritance rights. You should update your Will, designate guardians, and review beneficiary designations on insurance policies and RRSPs.
Learn about Wills & Estate PlanningOntario adoption law now recognizes that many adoptions benefit from some level of ongoing contact with biological family members. Openness Agreements allow for letters, photos, or visits while protecting your family's boundaries.
Our Approach: We draft Openness Agreements that honor the child's connection to their biological roots while ensuring you remain in control. These agreements are flexible and can be modified as your child grows.
Every signature brings you closer to bringing your child home.
Absolutely. Ontario law is fully inclusive. Same-sex couples (married or common law) have the exact same adoption rights as opposite-sex couples. The Child, Youth and Family Services Act does not discriminate based on sexual orientation or gender identity. We have successfully guided many LGBTQ+ families through the adoption process.
CAS provides legal representation for the adoption finalization, but you may want independent legal advice to understand your rights, review openness agreements, and ensure all documentation is properly completed. Many adoptive parents choose to have their own lawyer for peace of mind, especially if there are complex family dynamics or if they want to negotiate the terms of an openness order.
Step-parent adoptions typically take 6-12 months from start to finish. The timeline depends on:
If consent is disputed and we need to apply to dispense with consent, the process can take 12-18+ months.
SAFE (Structured Analysis Family Evaluation) is a comprehensive home study process required for most adoptions in Ontario. A licensed social worker assesses:
The study includes multiple interviews, home visits, and written reports. It typically takes 3-6 months to complete.
Private domestic adoption in Ontario typically costs between $15,000 and $30,000+. This includes:
Public adoption through CAS is free, though you may choose to hire your own lawyer for independent advice ($2,000 - $4,000).
Whether you're adopting through CAS, a private agency, or formalizing a step-parent relationship, we guide you through every legal requirement with care and efficiency.
