Building Your Family: The Legal Reality

Adoption is a beautiful emotional journey, but a rigorous legal obstacle course. You have the love and the home—we have the legal roadmap.

The Problem: One missing document, one incomplete background check, one improperly drafted consent form can delay your adoption by months. The process involves multiple government agencies, licensed social workers, and strict court procedures.

The Solution: Tailor Law manages the Licensees, the Children's Aid Society, and the Courts for you. We cut the red tape so you can focus on preparing your home and your heart.

Types of Adoption in Ontario

Each adoption path has unique requirements, timelines, and costs. We guide you through the right process for your family.

Public Adoption (CAS)

Adopting through Children's Aid Society. These are typically older children or sibling groups who need permanent homes.

  • Cost: Free (CAS covers legal fees)
  • Timeline: 12-24+ months
  • Children: Usually ages 3+, may have special needs

Private Domestic Adoption

Adopting newborns or infants through licensed adoption agencies. Birth parents choose adoptive families.

  • Cost: $15,000 - $30,000+
  • Timeline: 6-18 months (wait for match)
  • Children: Newborns to 2 years old

Competitive process. Requires profile creation and birth parent matching.

International Adoption

Bringing a child to Canada from another country. Requires compliance with both Ontario law and the child's country of origin.

  • Cost: $20,000 - $50,000+ (varies by country)
  • Timeline: 18-36+ months
  • Complexity: Immigration, translation, Hague Convention

Requires coordination with Immigration, Refugees and Citizenship Canada (IRCC).

MOST COMMON

Step-Parent & Relative Adoption

Formalizing existing family bonds. Step-parents adopting their partner's child, or grandparents/aunts/uncles adopting relatives.

  • Cost: $3,000 - $8,000 (legal fees only)
  • Timeline: 6-12 months
  • Key Issue: Biological parent consent required

Home study may be waived if child has lived with you for 2+ years.

The Biological Parent Hurdle

The most common obstacle in private and step-parent adoptions

Understanding Consent

In private and step-parent adoptions, biological parents must either consent to the adoption or have their parental rights terminated by the court. This is often the most emotionally charged and legally complex part of the process.

"We handle the uncomfortable conversations with biological parents so you don't have to. Our approach is firm but respectful—protecting your adoption while minimizing conflict."

— Deepa Tailor, Senior Family Lawyer

When Consent is Given:

  • Process is straightforward and fast
  • Parent signs consent form (witnessed)
  • 21-day cooling-off period applies

When Consent is Refused:

  • Court application required (Dispense with Consent)
  • Must prove parent abandoned or neglected child
  • Timeline extends to 12-18+ months

Important: The "Unknown Father" Scenario

If the biological father's identity is unknown or he cannot be located, we must conduct a diligent search and publish legal notices. This adds 3-6 months to the timeline but is legally required.

The Finalization: Your Happy Day

After months of preparation, the court hearing is the moment your family becomes legally permanent.

The Court Process

1

Application Filed

We submit your Application for Adoption to the Ontario Court of Justice, along with all supporting documents (home study, consents, background checks).

2

Court Hearing Scheduled

The hearing is typically brief (15-30 minutes) and celebratory. The judge will ask you about your readiness and commitment to the child.

3

Order of Adoption Granted

The judge signs the Order of Adoption. This creates a permanent, irrevocable legal parent-child relationship.

What the Order of Adoption Does:

Name Change: The child takes your surname (if desired)
Inheritance Rights: Full legal heir status
New Birth Certificate: Issued with your names as parents
Citizenship: Automatic Canadian citizenship (if applicable)

Important: Update Your Will Immediately

After adoption, your child has full inheritance rights. You should update your Will, designate guardians, and review beneficiary designations on insurance policies and RRSPs.

Openness Orders: The Modern Reality

Ontario adoption law now recognizes that many adoptions benefit from some level of ongoing contact with biological family members. Openness Agreements allow for letters, photos, or visits while protecting your family's boundaries.

What Openness Can Include:

  • Annual update letters (through agency)
  • Photo sharing on birthdays
  • Supervised visits (1-2 times per year)
  • Video calls (for older children)

How We Protect You:

  • Clear boundaries on frequency and method
  • Termination clauses if bio-parent violates terms
  • No disclosure of your home address
  • You retain full parental authority

Our Approach: We draft Openness Agreements that honor the child's connection to their biological roots while ensuring you remain in control. These agreements are flexible and can be modified as your child grows.

Frequently Asked Questions

Can same-sex couples adopt in Ontario?

Absolutely. Ontario law is fully inclusive. Same-sex couples (married or common law) have the exact same adoption rights as opposite-sex couples. The Child, Youth and Family Services Act does not discriminate based on sexual orientation or gender identity. We have successfully guided many LGBTQ+ families through the adoption process.

Do I need a lawyer for a CAS adoption?

CAS provides legal representation for the adoption finalization, but you may want independent legal advice to understand your rights, review openness agreements, and ensure all documentation is properly completed. Many adoptive parents choose to have their own lawyer for peace of mind, especially if there are complex family dynamics or if they want to negotiate the terms of an openness order.

How long does a step-parent adoption take in Ontario?

Step-parent adoptions typically take 6-12 months from start to finish. The timeline depends on:

  • Whether the biological parent consents (or needs to be served)
  • Whether a home study is required (may be waived if child lived with you 2+ years)
  • Court scheduling and backlog

If consent is disputed and we need to apply to dispense with consent, the process can take 12-18+ months.

What is a SAFE Home Study?

SAFE (Structured Analysis Family Evaluation) is a comprehensive home study process required for most adoptions in Ontario. A licensed social worker assesses:

  • Your home environment (safety, space, cleanliness)
  • Parenting capacity and motivation
  • Financial stability
  • Criminal background checks and references
  • Your understanding of adoption challenges

The study includes multiple interviews, home visits, and written reports. It typically takes 3-6 months to complete.

How much does private adoption cost in Ontario?

Private domestic adoption in Ontario typically costs between $15,000 and $30,000+. This includes:

  • Licensed adoption agency fees ($8,000 - $15,000)
  • SAFE Home Study ($2,000 - $4,000)
  • Legal fees ($3,000 - $6,000)
  • Birth parent expenses (where permitted by law)
  • PRIDE training and background checks

Public adoption through CAS is free, though you may choose to hire your own lawyer for independent advice ($2,000 - $4,000).
